Katy Perry’s ‘Dark Horse’ Charged in Copyright Infringement Case
A Los Angeles court has ruled that that Katy Perry’s song “Dark Horse” copied a Christian rap song.
As CNN explains, the song copies “Joyful Noise,” which was done by rap artist Flame. The trial wrapped up yesterday with a unanimous decision from the jury.
Although Perry testified about the creation of the track, she was not present when the verdict was read.
“Flame, whose real name is Marcus Gray, argued that ‘Dark Horse’ infringed on his copyright by using an underlying beat from his song without permission. Perry’s attorney argued, in part, that the portion in question was too common and brief to be protected by copyright.”
The 2013 song was written by Dr. Luke, Max Martin, Cirkut, and songwriter Sarah Hudson. Rapper Juicy J is also on the hit single.
When testifying, Perry said that the track was provided to her by Dr. Luke and Cirkut, and she had no knowledge that the song included parts that sounded like “Joyful Noise.”
The phase of the trial to determine damages owed starts on Tuesday.
